ASSOCIATE JUSTICE GABRIEL DUVALL – MANUSCRIPT LETTER SIGNED 06/18/1807 – HFSID 82239 GABRIEL DUVALL Hodijah Baylies (former Aide-de-Camp to Washington) is responsible for part of the expense of the government’s prosecution in a law suit. Manuscript LS: «G. Duvall» as Comptroller of the U.S. Currency, 1p, 8×10. Treasury Department, Comptroller’s Office, 1807 June 18. To Hodijah Baylies, Esquire. In full: «I have before me your letter of the 6th instant. It was proper that the sum paid by you, for expenses attending an enquiry respecting Simeon Jones, should be suspended from your credit until the result of the suit against Jones shall be known, when it must be charged in the account of Fines, Penalties and Forfeitures. This course is obviously proper, because as you are interested in the proceeds of the prosecution, it is reasonable that you should bear a proportion of every expense incident thereto. The charge will form a separate item distinct from the Clerk’s Marshal’s & Attorney’s accounts and need not be certified by the Court.» Docketed on verso by Baylies: «From the Comptroller June 18 1807/in reply to mine of the 6th/respecting the charges of the/enquiry respecting Jones.» Duvall served as a Democrat representing Maryland in Congress from 1794-1796. From 1802-1811, he was First Comptroller of the Treasury. Appointed by President James Madison, he served as Associate Justice of the Supreme Court from 1811-1835, when he resigned because of deafness. Folds, vertical fold between «uv» in signature.
